Trailborn terms of service

1. The provider

The service provider is Michał Mijalski, an individual running the Trailborn project under the name Forest Nap Studio.

2. What the service is

Trailborn is a mobile game in which your physical activity — steps and floors climbed — is converted into territory claimed on a world map. The service comprises:

• a player account and saved progress;
• the map, conversion of activity into metres, and claiming road segments;
• rankings, achievements, gear and chests;
• teams together with team chat;
• voluntary rewarded advertisements.

The service is currently free. Sales of the Trailborn Plus subscription are not enabled.

3. Technical requirements

• a device running Android 8.0 (API 26) or later;
• an internet connection;
• a Google account to sign in;
• to count activity: Health Connect or your phone's motion sensor;
• to play outdoors: location access.

4. Age

Trailborn may be used by people who are 16 or older. When you create an account you confirm with a single checkbox that you are at least 16. Giving a false age breaches these terms and may result in the account being removed.

5. Forming and ending the agreement

The agreement for the electronic supply of the service is formed when you create an account and accept these terms. It is concluded for an indefinite period.

You may end it at any time by deleting your account in the app (Settings → Account and data → Delete account) or through https://forestnap.com/delete-account/. Termination takes effect when the account is deleted and needs no reason.

The provider may terminate the agreement on 14 days' notice, given in the app or by email, and without notice in the case of a gross breach of these terms as described in section 7.

6. Rules of use

You agree to:

• give truthful information when creating an account;
• not manipulate steps, the GPS signal or network traffic;
• not use software that automates play;
• not create multiple accounts to evade limits or sanctions;
• walk only in places that are safe and lawfully accessible, obey traffic rules, and not use your phone in a way that takes your attention off your surroundings.

Supplying unlawful content is prohibited.

7. User content, moderation and sanctions

User content means: your nickname, team names and team chat messages.

7.1. Prohibited content

You may not publish content that:

• harasses, intimidates or demeans another person;
• constitutes hate speech on the basis of any protected characteristic;
• contains threats or incites violence;
• is sexual in nature involving minors, or sexualises minors;
• contains another person's personal data disclosed without their consent;
• is spam, advertising or an attempted fraud;
• infringes copyright or other third-party rights;
• is otherwise unlawful.

7.2. Reports

Any message, nickname, player profile or team name can be reported from within the app by choosing a reason and optionally adding a comment. Reports enter the moderation queue.

You can also block any user — their messages stop being visible and you receive no notifications about them. A block applies regardless of team membership and survives rejoining. The list of blocked people, and the option to unblock, is in Settings → Safety.

7.3. Sanctions

Where these terms are breached, a moderator may: remove the content, issue a warning, temporarily suspend the ability to post (for up to 30 days), or block the account. The sanction is matched to the seriousness of the breach and whether it is repeated.

7.4. Deleting your own messages

You may delete your own message within 24 hours of sending it. A team administrator may delete any message in their team. All messages disappear automatically after 24 hours.

7.5. Appeals

A moderator's decision may be appealed. Appeals are lodged in the app (Settings → Safety → Appeal a decision), with reasons. A person reviews the appeal. A decided appeal may uphold the sanction or overturn it; overturning lifts the warning, the suspension or the account block.

8. Advertising

Advertising in Trailborn is entirely voluntary: it appears only when you choose to watch an advertisement in exchange for a chest. There are no banners and no full-screen advertisements. Advertisements are always non-personalised.

9. Health features

Trailborn reads steps and floors climbed in order to convert them into metres in the game.

Trailborn is not a medical device, is not intended to diagnose, treat or monitor any health condition, and is not an emergency navigation system. The figures shown are indicative and depend on the accuracy of your device's sensors.

10. Availability and changes to the service

Maps, positions and statistics may be inaccurate or temporarily unavailable. The provider may correct results obtained in breach of these terms and may change game mechanics, announcing material changes in the app with reasonable notice.

11. Complaints

Complaints about the service may be sent to forestnapstudio@gmail.com, giving your nickname, a description of the problem and how you would like it resolved.

We consider complaints within 14 days of receipt and reply to the address the complaint came from.

12. Consumer rights

Nothing in these terms limits consumer rights arising from mandatory provisions of law, in particular the Polish Consumer Rights Act and the provisions on contracts for the supply of digital content and digital services.

13. Future payments

Sales are not enabled. Should they be enabled, all digital goods will be sold through Google Play, prices will come from the store, and these terms will first be supplemented with rules on purchases, refunds and the probability of obtaining randomised items.

14. Intellectual property

The Trailborn code and artwork belong to the provider. Third-party data and components are subject to the licences identified in the app.

Road data and OpenStreetMap

The road network you walk on comes from OpenStreetMap and is covered by the Open Database License (ODbL) 1.0. The database we build from it — road segments prepared for the game — is a derivative database within the meaning of that licence. In accordance with the ODbL we make it available under the same licence to anyone who asks; write to the contact address. This does not extend to player data: accounts, routes, claimed territory or statistics — those do not come from OpenStreetMap and are not part of the derivative database.

15. Governing law and disputes

Polish law applies to the agreement. This choice of law does not deprive a consumer of the protection of mandatory provisions of the country of their habitual residence.

16. Changes to these terms

We will announce changes to these terms in the app at least 14 days in advance. The version you accepted is stored with your account together with the date. If you do not accept a new version, you may end the agreement by deleting your account.
